STAGES, INC. for an increase in intra state rates.

By the Commission: Lewis Bros. Stages, filed an Application with the Commission for authorization to publish 4th revised page 6 to its P.S.C Utah Tariff No. 2, amending its present tariff by providing an additional service to the public, and to do so on one day's prior notice. The Commission, having reviewed the matter and being fully advised in the premises and having determined that this is appropriate subiect matter for its summary procedure. now makes the following Findings of Fact and Conclusion, together with its Order based thereon.

FINDINGS OF FACT 1. The Commission, pursuant to the provisions of Section 54-3-3, Utah Code Annotated 1953, as amended, is vested with authority to waive the thirty days' notice required in connection with the filing of tariffs, for good cause shown. 2. Petitioner, Lewis Bros. Stages, has proposed to publish, on one day's notice, 3 4th revised page 6 P.S.C.

Utah No. 2, which would amend its present tariff to make provision for an additional service to the public, i.c.. For passengers traveling or to Park City on the fares named in this item, carrier will provide transportation between carrier's Park City depot and destinations in Park City and points within 2 miles thereof, for a one-way fare of $1.50. 3. Good cause exists for the waiver of the notice provisions of Section 54-3-3 because the carrier has suffered an annual increase of $38,000.00 in the costs of its insurance, and must generate additional revenue to meet monthly commitments to pay for such insurance coverage.

The carrier will come before the Commission for a rate increase hearing at which time it will present to the Commission complete information regarding its revenues and the allocations of operating expenses as between interstate and intrastate services. 5. The Division has investigated the services of the carrier at Park City, and has concluded the carrier is rendering a useful and satisfactory service, and no complaint has been registered with the Commission on the carrier's fares services. CONCLUSION Based upon the foregoing Findings of Fact, the Commission concludes that the Application of Lewis Bros. Stages, should be granted as requested.

ORDER NOW, THEREFORE IT IS HEREBY ORDERED, That Lewis Bros. Stages, Inc. be and is authorized to publish 4th revised page 6 P.S.C. Utah No. 2 Tariff to become effective on one day's notice.

IT IS FURTHER ORDERED, That the fare implemented pursuant to this Order shall remain in force and effect for a temporary period not beyond May 1, 1978. IT IS FURTHER ORDERED. That the contents of this Tentative Order be published by Applicant in a newspaper of general circulation within the State of Utah and area involved, as soon as such can be reasonably accomplished, for at least two issues with proof of publication to be filed with this Commission fifteen days from the date of first publication. Unless meritorious written protest is filed within twenty days of the date of first publication thereof, this Tentative Order shall be in full force and effect as the Final Order of the Commission. Should any in terested party file written, timely and meritorious protest, the Commission may, in its discretion, set the matter for hearing or for further consideration.

Applicant alleges that the requested increase are necessary due to inflationary price spirals in the materials and labor necessary for the operating of its system. Additionally Applicant alleges that during 1976 it experienced a near doubling of purchased power costs from its wholesale suppliers. These wholesale power increases coupled with the increased operating costs have created a severe and serious financial position for the company such that substantial financial losses are now being experienced.
